Terms and Conditions

Effective date: April 3, 2025

Welcome to Somatelligence. These Terms and Conditions (“Terms”) govern your use of our website (the “Site”) and the services we provide. Somatelligence (“Somatelligence,” “we,” “us,” or “our”) is a body-based nervous-system recovery studio owned and operated by Sachi Berg in Oceanside, California, working with clients in person and virtually.

By using the Site, booking a session or event, or working with us, you agree to these Terms. If you don’t agree, please don’t use the Site or our services. These Terms work alongside our Privacy Policy and any agreement you sign when you book — including our health consent form, event waivers, and the Waves of Regulation Program Agreement.

We’ve kept these in plain language. If anything is unclear, ask us before you book, not after.

1. About Our Services

Somatelligence offers trauma-informed, body-based nervous-system recovery work. Sessions may draw on:

  • Somatic facilitation — guided movement, breath, and body awareness
  • Biodynamic craniosacral work — slow, still, gentle contact, hands resting lightly on or just above the body
  • Sound and frequency work — such as binaural beats, acupressure tuning forks, and bilateral stimulation devices
  • Reiki — energy work performed as a ceremony, with sound and earth gems, on a PEMF (pulsed electromagnetic field) mat

We also offer classes, sound baths, sound journeys, workshops, and events.

Our work is not massage, not a spa service, and not medical or mental health care. It supports your nervous system’s own capacity to regulate and recover, and it complements — but does not replace — care from licensed professionals.

2. Not Medical or Mental Health Care

This section matters, so we’ve made it clear:

  • Our services are not medical, psychological, psychiatric, or psychotherapeutic treatment, and they are not a substitute for care from a licensed physician, therapist, or other healthcare provider.
  • We do not diagnose, treat, cure, or prevent any disease, illness, or medical or mental health condition, and nothing we provide should be taken as medical advice.
  • We do not prescribe medication or medical treatment, and we do not perform spinal manipulation.
  • Statements on our Site and in our content are for general informational and educational purposes and have not been evaluated by the FDA or any regulatory body.
  • Continue working with your own healthcare and mental health providers, and consult them before making changes to your care.
  • In an emergency, or if you are in crisis or considering harming yourself or others, do not rely on this Site or our services. Call 911, go to your nearest emergency room, or call or text 988 (the Suicide and Crisis Lifeline) in the U.S.

Trauma-informed somatic work can bring emotions, sensations, or memories to the surface. We recommend that clients have appropriate mental health support in place. We are not a crisis service.

3. No Guaranteed Outcomes

Every nervous system is different, and this work moves at your body’s pace. We bring care, skill, and presence to every session — but we cannot and do not guarantee any specific result, outcome, or timeline.

Your participation, your history, and many factors outside our control all shape your experience. Client experiences we share describe individual results, have not been scientifically evaluated, and are not promises of what you will experience. The aim of this work is to support your own capacity to regulate and recover — not to promise a fixed endpoint.

4. Eligibility

You must be at least 18 years old to book and receive services and to make payments through the Site.

Services for minors are available only with the written consent of a parent or legal guardian, given on our Parent / Guardian Consent form before the first session, and — where appropriate — with the parent or guardian present, at our discretion.

5. Informed Participation, Consent, and Touch

Some of our modalities — such as biodynamic craniosacral work and Reiki — may involve gentle, near-field, or hands-on touch. Before and during your session, we’ll talk about what to expect, and:

  • Your participation is voluntary.
  • You may pause, adjust, or stop at any time, and you may decline any technique or touch — no explanation needed.
  • You consent to the touch and techniques involved in the services you book, and you understand you can withdraw that consent at any point.
  • If you feel any sensation beyond what you can comfortably handle, tell Sachi right away so she can adjust.

This work is collaborative. You are always the authority on your own body and experience.

6. Health Disclosure and Your Responsibilities

To keep your sessions safe, you agree to:

  • Provide accurate and complete information on intake forms, including the health consent form you complete when you book.
  • Disclose relevant health information — including injuries, recent surgeries, pregnancy, implanted electronic or medical devices such as a pacemaker, medical or mental health conditions, and medications — that could affect your care.
  • Let us know of any changes to your health over the course of working together.

Some modalities may not be appropriate for certain conditions. We may decline, modify, or refer out services based on what’s safe and appropriate for you. You are responsible for the choices you make about your own care.

7. Booking and Payment

Sessions, packages, memberships, classes, and events can be booked and paid for through our scheduling and payment tools — for example, Acuity Scheduling and its payment processor, or Venmo — or as otherwise arranged in writing.

Current prices, packages, and offerings are shown at the time of booking, and we may update them at any time. A price change never applies to something you’ve already paid for. Payment is due as shown at booking unless we’ve agreed otherwise in writing.

8. Cancellations, Rescheduling, Late Arrivals, and No-Shows

Your appointment time is held for you, and no one else can book it. So we ask for advance notice if you need to change it.

  • Notice: Please cancel or reschedule with at least 24 hours’ notice.
  • Late cancellations and no-shows: A cancellation or reschedule with less than 24 hours’ notice, or a missed appointment, is charged the full session fee. If the session was part of a package, membership, or program, that session is used.
  • Late arrivals: Your session still ends at its originally scheduled time, out of respect for the client after you. The full fee applies.
  • Our cancellations: If we ever need to cancel, we’ll give you as much notice as we can and either reschedule or refund the affected session.

Life happens. If a genuine emergency comes up, reach out. We’ll find a reasonable path forward within these policies — that’s a commitment to being human about it, not a second set of rules.

9. Packages

Packages — such as session packs and sound packs — are sessions bought together at a package rate.

  • Validity: Packages must be used within 3 months of purchase, unless a different period is stated when you buy. Sessions not used by then expire.
  • Final sale: Packages are a final sale. Completed sessions are non-refundable.
  • Unused sessions: Unused sessions are not refunded as a matter of course. Any exception is at our discretion, and where granted, it is prorated on unused sessions, less administrative and service fees.
  • Sessions booked from a package follow the cancellation policy in Section 8.

The Waves of Regulation program has its own terms, set out in Section 11.

10. Monthly Memberships

Some offerings are monthly memberships billed to the card on file.

  • Automatic renewal: A membership renews automatically each month until you cancel.
  • Notice before every charge: You’ll receive a notification 7 days before every charge, and you can cancel from that notification before the charge goes through.
  • How to cancel: Cancel at least 1 week before your renewal date to stop the next charge — from your renewal notification, or by emailing hello@somatelligence.com or texting (760) 512-3762. Your membership stays active through the end of the month you’ve already paid for.
  • Billed months are final: Completed sessions are non-refundable, and we don’t refund or prorate a billing month once it has started — including for sessions you didn’t use that month. Cancelling stops future charges; it doesn’t refund the current one.
  • Price changes: We’ll tell you in writing at least 7 days before any change to your membership price.

Some memberships carry a minimum commitment, which is stated clearly before you buy. The Waves of Regulation payment plan is one of these — see Section 11.

11. Waves of Regulation

Waves of Regulation is our 6-session program — a single container designed to be moved through as a series, not six separate sessions and not a balance to draw down at will. It follows your Foundational Session, so you’ll already understand the work you’re committing to.

The Program Agreement

Enrolling requires signing the Waves of Regulation Program Agreement. Before purchasing, you’re sent a link to the agreement for your chosen option. You review it, confirm each term, and sign it with your full legal name before you’re taken to payment. This section summarizes that agreement. Where the two differ, the agreement you signed applies.

Reserved time

When you enroll, we hold appointment times for you. Those hours come off the calendar and are not offered to anyone else. That reserved time is what you’re paying for.

Your options

Paid in full3-month plan
In person · 6 × 90-minute sessions$914, one payment. Not a subscription; won’t rebill.$57 one-time setup + $300/month for 3 months — $957 total. $357 due before your first session.
Online · 6 × 60-minute sessions$751, one payment. Not a subscription; won’t rebill.$57 one-time setup + $262.50/month for 3 months — $844.50 total. $319.50 due before your first session.

Scheduling

  • Sessions are booked every 1–2 weeks. The work depends on that rhythm.
  • Paid in full: all six sessions are scheduled at the time you enroll. If you choose not to book them then, the times offered to you may be taken by other clients, and it’s your responsibility to book your sessions within your 3-month window.
  • 3-month plan: you schedule two sessions in advance each month — the two that month’s payment covers.
  • Sessions not booked within the window they belong to are no longer available to you. This does not change your payment.

Validity

  • Paid in full: your six sessions are valid for 3 months from purchase. Sessions not used by then expire.
  • 3-month plan: each month’s two sessions belong to that month.

Final sale and refunds

  • Waves of Regulation is a final sale for the complete 6-session program. Completed sessions are final.
  • Time held for you is time no one else could book. A session you miss or don’t schedule is not returned to you as money.
  • Refunds are not given as a matter of course. Any exception is at our discretion, and where granted, it is prorated on unused sessions, less administrative and service fees.
  • 3-month plan: the commitment can’t be cancelled partway through. You remain responsible for the full amount, and the remaining payments can be paid at any time to close it out.

After your 3 months — 3-month plan only

Your plan is a monthly membership. Once your 3-month commitment is complete, it continues billing for two sessions a month — $300 in person, $262.50 online — until you cancel.

  • You’ll receive a notification 7 days before every charge, and you can cancel from it before the charge goes through.
  • Before your fourth month, we’ll also contact you to ask whether you’d like to continue.
  • From then on, Section 10 applies.

Included

In-person programs include one free Ripple Session sound bath — text us for a code whenever you’d like to join.

12. Virtual Sessions

For virtual sessions, you’re responsible for a stable internet connection, a working device, and a private, quiet, and physically safe space where you can participate without interruption.

We’re not responsible for technology failures on your end or interruptions outside our control. A session that can’t go ahead because of your setup is treated as a late cancellation under Section 8. If a technical issue on our side disrupts a session, we’ll reschedule or make it right.

13. Classes, Sound Baths, and Events

Registration for a class or event is confirmed once payment is received, where applicable. Spaces may be limited.

  • Event-specific cancellation, refund, and rescheduling terms are shown at registration.
  • You’ll be asked to sign an event waiver before taking part.
  • Events may be photographed or recorded, as described in that waiver.
  • If we reschedule or cancel an event, we’ll notify registrants and offer a reschedule or a refund for that event.

14. Recordings and Confidentiality of the Space

To protect everyone present, you agree not to record — audio or video — any session, class, or event without our express permission. We treat what you share with us as confidential, as described in our Privacy Policy, except where disclosure is required by law.

15. Intellectual Property

The Site and our content — including text, images, recordings, sound and frequency work, written materials, branding, and the Somatelligence name — are owned by Somatelligence or used with permission, and are protected by intellectual property laws. You may not copy, reproduce, distribute, sell, or create derivative works from our content without our written permission, except for your own personal, non-commercial use.

16. Client Conduct and Right to Decline Service

We’re committed to a respectful, safe environment for our clients and for Sachi. We may decline, pause, or end services — and may remove someone from a class or event — if behavior is disrespectful, unsafe, or disruptive, or if the work is no longer appropriate or a good fit. Where a session is ended early for these reasons, fees already paid for that session are not refundable.

17. Disclaimers

The Site and our services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don’t warrant that the Site will be uninterrupted, error-free, or secure, or that any particular outcome will result from our services. Some jurisdictions don’t allow certain disclaimers, so some of the above may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, Somatelligence and Sachi Berg will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the Site or our services. To the extent we are found liable, our total liability will not exceed the amount you paid us for the specific service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

You acknowledge that you participate in our services voluntarily and that you assume the ordinary risks involved in somatic and body-based work.

19. Indemnification

You agree to indemnify and hold harmless Somatelligence and Sachi Berg from any claims, damages, losses, or expenses — including reasonable attorneys’ fees — arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

20. Third-Party Links and Platforms

Our Site and services use or link to third-party platforms — such as our scheduling and payment tools, Tally (where our agreements and forms are signed), ClassPass, Eventbrite, Instagram, and Substack. We don’t control and aren’t responsible for their content, terms, or privacy practices. Your use of those services is governed by their own terms. If you book through ClassPass or a similar platform, its terms apply alongside ours.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before pursuing any formal action, you agree to first contact us so we can try to resolve the matter informally and in good faith. Any dispute that can’t be resolved that way will be handled in the state or federal courts located in San Diego County, California, and you consent to that jurisdiction and venue.

22. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll revise the effective date above, and significant changes will be communicated by reasonable means. Your continued use of the Site or our services after an update means you accept the revised Terms.

An update never changes an agreement you’ve already signed. A package, membership commitment, or Waves of Regulation program you’re already in continues under the terms you agreed to when you bought it.

23. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy, any terms presented at the time of booking, and any agreement you sign with us — including the Waves of Regulation Program Agreement — make up the entire agreement between you and Somatelligence regarding the Site and our services.
